HC asks factory owner to pay Tk 30 lakh for damaging a child’s arm

The High Court on Wednesday asked the owner of Nuru Engineering Workshop at Kamolpur in Bhairab to pay a 13-year-old child Tk 30 lakh as compensation for damaging his right arm.

The victim, Naim Hasan Nahid, a Class VII student, was forcefully engaged in operating a heavy auto drill machine during the Covid-2019 pandemic in 2020.

 

The court also asked the industry’ owner Yakub Hossain to pay the boy Tk 7,000 every month until the boy completed his education till higher secondary level.

The court asked Yakub to pay the compensation amount in two installments — Tk 15 lakh in April and Tk 15 lakh in December 2024— through Naim’s bank account with Al Arafa Islami bank’ Jatrabari branch in the capital.

The court asked the boy to deposit the amount as Fixed Deposit Recipients for 10 years.

The court also asked Yakub to submit a compliance report to it each three months about execution of the directives.

The bench of Justice Naima Haider and Justice Kazi Zinat Hoque issued the directive after disposing of a writ petition filed by the boy’s father Anwar Hossain seeking Tk 2 crore as compensation for amputation of his right arm from elbow.

The court also asked Yakub not to proceed with the criminal case filed with the lower court against the factory and its owner over the damage of his son.

Anwar said that his school going son was appointed as peon during the closure of the educational institutions due to Covid pandemic, but he was later forced to work in operating drill machine.

Lawyer Aneek R Haque appeared for the victim’s father while lawyer Md Qamrul Islam defended the factory owner.
