HC rejects writ seeking probe into interim government’s ‘constitutional violations’

The High Court on Thursday summarily rejected a public interest litigation writ petition that sought a direction on the government to explain why it should not be ordered to form an independent commission to investigate the alleged constitutional violations by the interim government led by chief adviser Professor Muhammad Yunus.

The bench of Justice Ahmed Sohel and Justice Fatema Anwar passed the order after hearing the writ petition filed by lawyer Mohsen Rashid.

Attorney general Md Ruhul Quddus, briefing reporters after the hearing, said that the court observed that the petitioner had earlier challenged the legality of the interim government and that both the High Court and the Appellate Division had already rejected the matter.

‘The detailed order will come later,’ the attorney general said.

He said that the High Court observed that Mohsen Rashid had previously filed a writ petition challenging the legality of the interim government led by Professor Muhammad Yunus, which had been rejected by the High Court, while the Appellate Division also dismissed the appeal on December 4, 2025.

‘The court observed that he cannot file another case on the same issue,’ Ruhul Quddus said.

Referring to another observation of the court, the attorney general said that matters relating to foreign relations and agreements with other countries fell within the exclusive domain of the government.

‘The state is run by the government on behalf of the republic. Whether the government will enter into foreign relations or agreements with another country is entirely a matter for the government,’ he quoted the court as saying.

He further said that the court observed that the government may exercise its authority under the relevant 1956 law whenever it deems necessary and that no such action had yet been taken by the government.
