HC clears way for ex-CJ Khairul’s release with bail in last two cases

The High Court on Tuesday granted interim bail to former chief justice ABM Khairul Haque in the last two cases filed over killings during the 2024 July uprising, clearing the way for his release from jail.

The HC bench of Justice KM Zahid Sarwar and Sheikh Abu Taher passed the order after hearing his bail petitions.

 

Earlier, on April 28, the Appellate Division upheld High Court orders granting Khairul bail in five other cases.

A five-member bench led by the chief justice dismissed separate state petitions seeking to stay the HC bail orders issued on March 8 and March 11.

Khairul could not secure release earlier as he remained shown arrested in two other cases — one filed with Jatrabari Police Station over the killing of madrassah student Arif and another filed with Adabar Police Station over the killing of Rubel during the mass uprising, his lawyer Md Motaher Hossain Sazu told New Age.

The High Court granted Khairul bail in the two cases on Tuesday.

On March 11, the High Court also granted Khairul permanent bail in a corruption case filed by the Anti-Corruption Commission.

The case, filed in August 2025’, accused Khairul and seven officials of Rajdhani Unnayan Kartripakkha of obtaining a 10-katha plot by using false information and abusing power.

Earlier, on March 8, the HC granted him bail in four other cases. One case was filed with Jatrabari Police Station over the killing of Juba Dal activist Abdul Kaiyum Ahad during the July movement. Another was filed with Shahbagh Police Station by Supreme Court lawyer Mujahidul Islam Shaheen alleging forgery linked to the caretaker government verdict.

Two similar cases were also filed with Fatullah Police Station and Bandar Police Station on August 25 last year.

Khairul served as chief justice from September 30, 2010 to May 17, 2011. During his tenure, the Appellate Division on May 10, 2011 delivered the landmark verdict that scrapped the 13th Amendment to the Constitution, ending the caretaker government system introduced in 1996.

Police arrested him from his Dhanmondi residence on July 24, 2025, nearly a year after the July mass uprising and the fall of the Awami League government.
